Background

Edisonian Innovative Works, LLC (Edisonian), an Internet development, management and consulting firm based in the State of Maryland, is doing business as dotDNA (dotDNA.com) for the purpose of providing hosting and domain name services on the Internet.

Acceptance

You understand, acknowledge, and agree that by submitting your payment to dotDNA.com for any and all hosting and other services provided by dotDNA.com, you shall abide by the terms and provisions stated herein.

30-Day Money-Back Guarantee

dotDNA.com offers a our commitment to pay your money back in the event you are not satisfied with our hosting services. In order to get a refund, you must cancel your hosting plan within the first thirty (3)days of service. Please note, however, that it is your responsibility to transfer your files to another server. We reserve the right to deny your refund if you have violated any of the provisions in our TOS or AUP. We DO NOT refund partial monthly fees to accounts that have canceled after the first 30 days of their hosting service.

Server Back-Ups

dotDNA.com is NOT responsible for backing up your website files. It your responsibility to perform back ups of your site. If, under the unfortunate circumstance that something happens to your website files, it is your responsibility to have filed a local copy of them. dotDNA.com will not be held liable in any way for any files, scripts, software, money, time, effort, etc. lost due to this unfortunate event. I your files are lost, we will make attempt to restore them as a gesture of good faith, but we make no promises whatsoever in terms of whether the files can be restored.

Server Abuse

You are prohibited from causing harm to our servers (or to our website). This includes, but is not limited to attempting to manipulate, modify, corrupt our website, server or files, and gaining access to password files other than your own, attempting to gain unauthorized access to other accounts on your server, or anything that causes website or server malfunction. If you violate this provision your account will be terminated immediately without a refund.

Mirroring

You are prohibited from using your website to mirror material on any other site without our express written permission.

Acceptable Use Policy (AUP)

You may only use our hosting service for legal purposes. The following content and activities are prohibited:

1. Any content or activity that we deem to constitute or promote hatred, threats, terrorism, obscenity, discrimination, or illegal activities.

2. Use of any content that violates U.S. Federal, State or local law.

3. Spam or any form of unwanted and/or unauthorized electronic communication. We have the sole discretion to defining and determining what constitutes spam.

4. Copyrighted material used without permission, and or materials that are protected by trade secret or other statute.

5. Pornography, nudity, erotica, and sex-related merchandising, including sites that may infer sexual content, or link to adult content elsewhere.

6. Content, materials, software or anything that may strain or adversely affect our servers, or any other server on the Internet.

7. Any use of promotion of pirated software and/or cloned websites.

7. Using or promoting hacking, viruses, phreaking, or any software or system believed to be a threat to our servers or any other servers.

8. Use of SPAM or any system for distributing or send unwanted commercial messages.

Modifications of this Agreement

We reserve the right to revise, amend, or modify our TOS, AUP and any other agreements and/or policies at any time, and in any manner, without any notice to you. It is your responsibility to periodically check our TOS and other agreements for updates.

Limitation of Liability

dotDNA.com hereby disclaims all liability regarding from the use of our website or our hosting services. To be specific: In no event shall dotDNA.com be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out, of or in any way connected with, the use of this web site or with the delay or inability to use this web site, or for the materials obtained through this web site, or for any claimed damage from our hosting services going off-line or being unavailable or damage resulting from corruption of deletion of any website from dotDNA.com servers, or any other damages resulting from our hosting services or otherwise arising out of the use of this web site, whether based on contract, tort, strict liability or otherwise, even if dotDNA.com has been advised of the possibility of damages.

Refusal of Service

We reserve the right to refuse or cancel service at our sole discretion, with or without reason, and with or without warning.

Severability

If any provision of this Agreement, whether by sentence, paragraph, or article, is held to be void or unenforceable, all the other provisions herein shall nevertheless continue in full force and effect.
